Bank of America wrote to the office Andrew Cuomo, the New York attorney general, on October 12 saying it had “reconsidered its position” on the release of documents it had previously said were private because of attorney-client privilege.

The bank said it would in fact provide documents relating to disclosures surrounding its acquisition of Merrill Lynch, and aimed to do so by October 16.


 


 

RELATED STORIES

The release of documents relating to the bank’s purchase of Merrill will include the legal advice BofA says it followed. Hindsight has endowed some legal eagles, as well as the bank’s bosses, with tin ears – at best. Things could get uncomfortable for counsel.
